MINUTES- SELECTMEN’S MEETING TOWN OF BARNET, VT. MONDAY, NOVEMBER 10, 2008 Meeting began at 7:00 PM Board members present: Selectmen Theodore Faris, Stanley Robinson, and Jeremy Roberts. Others present: Town Clerk William Hoar, Sally Cook of Caledonian Record; Shirley Warden, Tim Gibbs, Roy Vance, Lawrence & Cynthia Ruggles, Ross Page, and Gail Warnaar. APPROVAL OF MINUTES OF PREVIOUS MEETING Motion made by Robinson and seconded to approve minutes of meeting held on October 27, 2008. Seconded and unanimously approved. CALEDONIA COUNTY BUDGET PRESENTATION Asst. Judge Roy Vance appeared to present the proposed County budget for 2009-2010 to the Board. The proposed spending for the forthcoming budget will total $389,956 which includes $127,556 for the Sheriff’s Dept.. This is compared to a total budget of $383,604 last year. Roy went through the line items explaining the changes. The Towns in Caledonia County paid $283.725 in taxes to the County last year. This year’s figure is expected to be slightly higher. Once the County receives the State report of estimated fair market values in each town as of Dec. 31, 2008, they will notify each town of the assessed tax for the 2009 town budget. APPEARANCE BY BARNET RESIDENT(S) WITH CONCERNS ABOUT NEW TOWN GARAGE Barnet residents Lawrence & Cynthia Ruggles appeared to express their concerns about the construction of the new garage. They stated that several town residents have approached Larry with questions about the construction. Larry has offered, both in writing and verbally, to help the Selectmen with oversight of the construction work. He restated his offer to do this work for the remainder of the project for no charge. He felt that if the Board does not wish to take him up on his offer, then several issues need to be aired in public. Stan Robinson stated he is very interested in having Larry help out. Ted Faris asked him to talk about his list of concerns. Larry stated that his concerns deal with: -construction details and design; -budget and whether town will build it for the $280,000 estimate given out; -presented pictures taken today and he is concerned about the quality of the work; -concerned that one of anchor bolts has a large crack in it. Motion by Robinson to have Larry Ruggles as town consultant for the Town Garage project as per his offer. Seconded and unanimously approved. APPEARANCE BY ROSS PAGE RE: SNOWMOBILE TRAVEL Ross Page appeared to request use of a portion of Somerhill Road in West Barnet for snowmobile travel this coming winter. The portion of the road needed would run from Richard Price’s land to the property of Lenton and travel would be on the side of the road. Road Foreman Tim Gibbs was present and he is OK with this but did feel that Ross should talk with the Lenton’s about this as they will be most affected by the noise. Motion by Roberts to allow this request as presented. Seconded and unanimously approved. APPREARANCE BY BARNET FIRE DISTRICT PRUDENTIAL COMMITTEE MEMBER RE: VACANCY ON THE BOARD Barnet Fire District Prudential Committee member Gail Warnaar appeared to inform the Selectmen that one of their trustees(Garry Dunbar)has resigned. Gail is asking the Board to appoint Joshua Puffer to fill this vacancy until their annual meeting in January. They do need an immediate appointment as they are dealing with issues involving the possible purchase of the water system. Motion by Stan Robinson to appoint Joshua Puffer to Fire District Prudential Committee to replace Garry Dunbar until their next annual or special meeting. Seconded and unanimously approved. HIGHWAY ACCESS PERMIT Approved request for temporary highway access permit on Field Road requested by Geoffrey Spence. This will be a six month permit for logging purposes. TOWN GARAGE CONSTRUCTION COSTS Construction costs as of Nov. 7, 2008 are $189,243.51 plus $70,000.00 land acquisition cost. EXECUTIVE SESSION Motion made by Faris to go into executive session at 8:15 PM to review employment applications for opening on town highway crew. Motion seconded and approved unanimously. MONDAY, OCTOBER 27, 2008 Meeting began at 7:00 PM Board members present: Selectmen Theodore Faris, Stanley Robinson, and Jeremy Roberts. APPROVAL OF MINUTES OF PREVIOUS MEETING Motion made by Robinson and seconded to approve minutes of meeting held on October 13, 2008. Seconded and unanimously approved. HIGHWAY RELATED ITEMS -Signed standard subgrant agreement with the State of Vermont as part of the paperwork required for receiving Federal and State assistance from FEMA for disaster expenses for flooding that occurred in July and August of this year. -Signed reimbursement request to St. of Vt. for work recently finished on the bridge on Keyser Hill Road. The bridge is now open to traffic. -Approved two highway access permits for Bob Hoffman on Chamberlain Road. Culverts will not be required. -Road Foreman Tim Gibbs suggested that in the future the Town get rid of the Pickup truck and purchase a low boy type of truck with a plow for more effective use for plowing and also could be used for sanding. -Board to place notice in Caledonian Record asking for resumes from anyone interested in working on the road crew. Crew member David Stevenson is retiring this Friday. To have requests in by November 5th. APPEARANCE BY TAX COLLECTOR Tax Collector Donald Nelson appeared to request permission from the Selectmen to proceed with tax sale notices on selected parties whose delinquent go back three years. Board so granted his request. Donald also announced that he will not be seeking re-election in March of 2009. LETTER FROM VLCT: RESOLUTION AGAINST FUNDING CUTS BY ST.OF VT. FROM TRANSPORTATION FUND Board read letter from the Vt. League of Cities & Towns that has been sent to all towns asking for their support in opposing the cuts to aid to cities and towns from the highway fund as proposed by Douglas administration. The cut for the Town of Barnet would amount to $13,291.46. Motion by Robinson to sign a resolution showing support for the efforts of the VLCT. Seconded and unanimously adopted. OTHER BUSINESS The Board of Listers requested approval to expend funds in the amount of $3,900 for computer software from Cartographic Associates Inc. of Littleton, NH. This software will enhance the use of computer programs already in existence for mapping of parcels of land with assessment information shown. The price includes money for training of the Listers to use this program. Motion by Roberts to so approve use of $3900 in funds for this project. Funding will come out of Act 60 Reserve fund account. APPROVAL OF MINUTES OF PREVIOUS MEETING Motion made by Robinson and seconded to approve minutes of meeting held on September 22, 2008. Seconded and unanimously approved. APPEARANCE BY NVDA REP. DAVID SNEDECKER David Snedecker appeared from NVDA to discuss bulk purchase agreements by towns in the area if there is any interest. They are talking about finding out if interest is strong enough to look into purchasing items such as culverts, tires, etc.. He is asking towns that if they have an interest, please give NVDA some idea of the amount that would be purchased. APPEARANCE BY RESIDENT LARRY RUGGLES Resident Larry Ruggles appeared to express his concerns about the condition of the newly paved section of Roy Mountain Road. With this summer’s rain, the washout on the road is causing problems with the shoulder and Larry feels that if something is not done some, there will be damages done to the newly paved section. Board is aware of this, but will go out and take another look. Road Foreman Tim Gibbs has been talking with contractors about repairing this. UPDATE TO 2008 GRAND LIST Read request from Board of Listers to correct 2008 Grand List by adding a parcel that was inadvertently left off this years Grand List. The parcel is #8-09-01-57.2 owned by Gary & Sharon Roy and Mark & Laurie Jefferson. It is a mobile home on the West Barnet Road. So approved by the Board to add this to the Grand List. APPROPRIATION REQUESTS FOR 2009 Read requests from N.E. Kingdom Learning Services, N. E. Kingdom Youth Services, and N. E. Kingdom Human Services for appropriations on the 2009 Town Meeting Warning for the same amount as in 2008. Barnet Public Library sent a letter stating their request in 2009 will be $19,500-up from $18,500 in 2008. KEYSER HILL BRIDGE UPDATE The Board has signed an agreement with Joseph P. Carrara & Sons of Middlebury, Vt. for four (4) precast concrete sold deck beams to be installed to repair the bridge on Keyser Hill Road. This work is expected to be done next Tuesday and the Selectmen anticipate the bridge to be open by November 1st. We have received notice that the State of Vt. has approved using funds originally approved to repave the Passumpsic Village bridge to pay for this project. The four concrete beams to cost $28,725.00. NEW TOWN GARAGE COSTS TO DATE Total costs expended to date on the construction of the new town garage is $119,116 according to treasurer William Hoar. This does not include the $70,000 price paid for the land. DELINQUENT TAXES FOR 2008 Town Treasurer William Hoar reported that 2008 delinquent taxes are $255,374.53-up from $156,358.21 in 2008. OTHER BUSINESS -Read note from Tower Road resident David Kristoff asking to discuss some kind of road maintenance program on the Class 4 section of Tower Road. He would be willing to do some minimal maintenance himself. No decision made. - Read e-mail from recycling attendant Bruce Marston that also had pictures of the overcrowding situation at the recycling center. APPROVAL OF MINUTES OF PREVIOUS MEETING Motion made by Robinson and seconded to approve minutes of meeting held on September 8, 2008. Seconded and unanimously approved. TOWN PLAN ADOPTION Discussed adopting the proposed Town Plan as discussed at our last meeting. Ted Faris would like to see a change on page 29 under Item 18 (Implementation of the Plan). He said that under Agriculture, items 1 and 2 should be reversed. The question is does this require a new public hearing? Shirley Warden, Secretary for the Planning Commission, does not believe it does require a new hearing. Motion made by Roberts to adopt the revised Town Plan with the above change. Seconded and unanimously approved. APPEARANCE BY ROAD FOREMAN TIM GIBBS Road foreman Tim Gibbs appeared to discuss various items that have occurred in his first three weeks on the job. Tim reported he is working on Roy Mountain Road to keep from losing any of the new pavement into the recently cleaned out ditches. When the ditches were cleaned out after heavy rains, they were cut in such a way that it is undermining some of the roadway. He is waiting for a price on work to help this out. Discussion ensued on his grading of roads in Town. He plans to stay in one area until the roads are graded and then move throughout the town-not going from one end of the town to the other. Tim does feel that there is a great need for brush cutting and the best investment the town could make next year is a mowing tractor with a bush hog. Continued to talk about various items and the Board expressed their approval of the work he had done to date. Old Silo Road resident Hiram Allen appeared to let the town know that the pavement on the East Barnet bridge is starting to crumble. FEMA MEETING RE; AUGUST FLOODING Selectmen Ted Faris and Town Clerk William Hoar attended the FEMA meeting held in Lyndonville last Friday to start the procedure for making claims for state and federal assistance for flood damages done in August. Town should be reimbursed for 90% of the damages for approved sites. They will meet with the Selectmen on September 30th to visit the sites. BRIDGE REPAIRS TO KEYSER HILL BRIDGE Selectmen have been advised that we have tentatively found a funding source to repair the damaged bridge on Keyser Hill. We have had a grant approved to repair the pavement on the bridge in Passumpsic Village over the Passumpsic River. It appears that we will be able to amend this grant to change it to the Keyser Hill Bridge. We should have paperwork signed within the next two weeks. Meeting ended at 7:30 PM. APPROVAL OF MINUTES OF PREVIOUS MEETING Motion made by Robinson and seconded to approve minutes of meeting held on August 25, 2008. Seconded and unanimously approved. PUBLIC HEARING ON PROPOSED TOWN PLAN This hearing is being held as advertised as the second step in the process of adoption of an updated Town Plan for the Town of Barnet. Those in attendance for this portion of the meeting brought out the following comments. Jim MacDonald asked if the shoreline regulations mentioned on page 10 were the same as included in the zoning regulations. Later in the meeting, Planning Comm. Chairman Dennis McLam arrived and made the comment that yes they are the same. The Plan merely states that there will be shoreline regulations-it does not spell them out in detail. Mr. MacDonald’s other comment dealt with the issue of recreation and the formation of a recreation committee. Is this different than the Beach Committee and is it anticipated to be formed in the near future? Chairman McLam said he did not feel it would replace the Beach Committee at whatever date it is formed. Mr. & Mrs. Anderson stated they were concerned about the quality of Harvey’s Lake. Wayne Berge commented that under water quality issues mentioned on page 12, a recommendation should be made for financial support for the boat monitoring program at Harvey’s Lake. Selectmen stated they will try to adopt the Plan at their next meeting scheduled for Sept. 22nd. They did ask those in attendance to make their comments in writing. TAX ABATEMENT REQUEST The Board read a letter from the Board of Listers requesting the removal of parcel #8-20-21-21 (First Presbyterian Church of W. Barnet) from the tax rolls. This parcel contains the store owned by the Church. The Listers had received information that the store has received non profit tax status from the IRS and after discussing this with State of Vt. officials, it should be considered tax exempt. The assessed valuation is $49,500 and the tax for 2008 is $864.02. Ted Faris excused himself from this matter as he is involved with the Church. Motion by Robinson to so correct the 2008 Grand List to reclassify this property as tax exempt. Unanimously approved. HARVEY’S LAKE DAM-DRAWDOWN OF WATER LEVEL The Board has been asked by the Lake Harvey Association to consider changing the dates for the lowering of the water level on the lake during the Fall. In the past we have lifted boards from the dam on Sept. 15th and replaced them on Oct. 15th. Several owners on the lake would like it left up through Columbus holiday. Board decided to change the date of removal of the boards to a date between Oct. 7th-10th and to leave the exact time up to George Coppenrath, who does the actual plank removal. Will replace the boards about 1 month later. STATUS OF BRIDGE REPAIRS ON BRIDGE#33-KEYSER HILL ROAD Ted Faris reported he has received an estimate of about $15,000 to work on the deck of the bridge plus $15,000 for related road work. The State of Vt. has advised the Town they do not have extra funds to help the Town with this. It is a possibility that we may be able to change an existing grant awarded to the Town this year to repave the bridge in Passumpsic Village and use it on this bridge. We are waiting to hear on this possibility. OTHER BUSINESS Read letter from local businessman Larry Ruggles offering his services, at no cost, to help in anyway with the construction management of the new town garage. Meeting ended at 8:00 PM. APPROVAL OF MINUTES OF PREVIOUS MEETING Motion made by Robinson and seconded to approve minutes of meeting held on August 11, 2008. Seconded and unanimously approved. EMERGENCY ORDER ISSUED BY HEALTH OFFICER Read for the record an emergency order issued by Health Officer Theodore Faris dated August 15, 2008 relative to the Harpin residence in Passumpsic. Order contains requirements that garbage be removed and disposed of in a sanitary manner within 15 days; immediate control of insects be addressed with an evaluation by a competent exterminator; that the premises be secured to prevent rodent infestation. Ted Faris reported that there will be an on site meeting with the USDA on August 26th. PERMIT REQUEST TO BURY CABLE UNDER CRD ROAD-E.BARNET Stan Robinson reported that he had been contacted by the railroad asking for permission to place buried cable on the CRD Road in E. Barnet Village. Selectmen gave their approval with the condition that the road is not to be closed. KEYSER HILL BRIDGE STATUS Selectmen reported that they have estimates to fix damaged bridge on Keyser Hill of $15-20,000 for the steel replacement and $15,000 for the concrete fascia. Ted Faris to talk with Agency of Transportation about aid available to the Town. STEVENS CEMETERY RESTORATION WORK Accepted quotation from Gandin Bros. for work on stones in Stevens Cemetery that cannot be repaired or need to be replaced. The price given was $400 each for 4 stones to be replaced and $700-800 for 8 stones to be repaired. This work to be done in 2009. TOWN GARAGE ITEMS Leigh Larocque appeared to discuss testing to be done on concrete and soil. Work is in progress on foundation and site work. David Stevenson expressed concerns about entrance to the office area at the new garage. Noted receipt of quote on drilling new well. Will hold off until we receive another quote. \OTHER ITEMS -Read letter from Meaghan Burke about rental of beach area for a wedding in October of 2009 and response from Beach Committee about new fees that may come into effect in 2009. Selectmen want to discuss this with Beach Committee before making any comments. -Board decided to sell old plow to Bob Veilleux for $175.00. -To delay screening winter sand until September. -Shirley Warden made comments about problems with bridge on Warden Road. APPEARANCE BY LANDOWNERS ON CHAMBERLAIN ROAD:
Paul Toney and his son appeared to talk about the status of the Chamberlain road which borders his property along the Peacham line. They had appeared at a recent meeting and had discussed the possibility of having this section of the road discontinued. After they talked with the adjoining landowners, they have decided not to pursue this action. They appeared to tell this to the board and to ask the Town to do some work on the road to fix the ruts and to see work done on the culverts. They said if the Town does wish to discontinue the road, they would repair it. Selectman Robinson stated the culverts will receive some attention before winter. Asked if there are plans to do some work on the Rakefactory Road. Bridge will be fixed and some work on the road will be done at some point. HIGHWAY ACCESS PERMITS Approved the following highway access permit requests: 1. William Pearl for a driveway on Pearlmont Rd. leading to new sugarhouse. After discussion with Ted Faris, agreed to move access point up hill for better visibility. 2. Jonathan & Leigh Root for a driveway on Little France Road. APPOINTMENT OF ROAD FOREMAN Announced that the Board has hired Tim Gibbs of the West Barnet Road as the Town’s new Road Foreman. He will start work on August 18th. BIDS ON NEW TOWN GARAGE WORK Accepted bid of Calvin Bunnell, d/b/a C&C Bunnell Excavating for the following: -Site work (excavation & backfill) $ 13,500 -Septic system (mound system) $ 11,000 -Trucking by Yard $ 4.75 Other bids: Mathews Excavating – total for all = $27,910; trucking by yard= $3.75 Dell’s Const.-total for all = $27,775; trucking by yard=$5.00 OTHER BUSINESS -Briefly discussed flooding of last week. We expect that FEMA representatives will be visiting at some point to inspect damages. -Talked about the anticipated re-opening of the damaged bridge on Keyser Hill. APPROVAL OF MINUTES OF PREVIOUS MEETING Motion made by Robinson and seconded to approve minutes of meeting held on July 14, 2008. Seconded and unanimously approved. OPEN BIDS ON CONCRETE WORK FOR NEW TOWN GARAGE Opened bids for foundation work for the new town garage. Bids submitted were as follows: 1. Ross C. Page - $70,995.00 2. Harold’s Concrete Const.- $71,012.50 Motion by Robinson to accept bid of Ross C. Page for $70, 995.00. Seconded and unanimously approved. Ross Page was in attendance and did leave a list of questions he felt needed to be addressed with the structural engineer before the work begins. At this point, the Board did open bids for site preparation work, but due to questions about the specifications not being clear or perhaps omitted, the Board decided to meet with the bidders to clarify some issues before making bids public and deciding on which bid to accept. PERMIT FOR DISCHARGE OF STORMWATER FOR TOWN GARAGE PROJECT RECEIVED Read letter from Vt. Dept. of Environmental Conservation notifying the Town that our filing for a permit for the discharge of stormwater as part of the town garage construction project has been approved. The authorization is valid for two years. Submitted with the letter were forms and instructions that must be followed during the construction. NEW TIPPING FEES FOR TRANSFER STATION Board discussed the need to raise fees that are charged at the transfer station for the disposal of household solid waste. Board voted to place the following fees in effect starting on Saturday, August 16, 2008: -small kitchen bags -- $1.00 -30 gal. bags -- $2.00 -large plastic trash cans -- $5.00 HIGHWAY ACCESS PERMIT A permit for a driveway on Pearlmont Road was submitted by William Pearl which will be used for access to a new sugarhouse. Problems have arisen dealing with visibility in one direction. Board decided to have Ted Faris deal with this and to work out a solution. HEARING DATE FOR REVISED TOWN PLAN Board set a date of Monday, September 8, 2008 at 7 PM for their required hearing on the adoption process for a new Town Plan. NVDA to handle publication requirements. OTHER BUSINESS -Decided to purchase a one year extended service contract for the Cat Backhoe through the Cat dealer for a cost of $925.00. -Ted briefly went over an estimate of cost to repair the bridge that has been damaged on Keyser Hill Road. He believes the deck can be repaired for $9,300 and the guardrail costs have been quoted at approximately $3,000. Ted has sent figures to the State to see if they feel the proposal is adequate. Meeting ended at 8:08 PM. MINUTES- SELECTMEN’S MEETING TOWN OF BARNET, VT. MONDAY, JULY 14, 2008 Meeting began at 7:00 PM Board members present: Selectmen Theodore Faris , Jeremy Roberts, and Stanley Robinson. Others present: Town Clerk William Hoar, Shirley Warden, Sally Anderson Cook of Caledonian Record, William Vermuelen, Chad Dunbar. APPROVAL OF MINUTES OF PREVIOUS MEETING Motion made by Robinson and seconded to approve minutes of meeting held on June 23, 2008. Seconded and unanimously approved. DRAINAGE REPAIRS IN FRONT OF BARNET POST OFFICE William Vermuelen, the owner of the property which houses the Barnet Post Office, appeared to discuss repairs he needs to do to the area immediately in front of the post office. The parking area has a problem with a drainage pipe that runs under the pavement and causes problems with walking into the post office. The Postal Service has told him he needs to remedy this issue by the end of August. The place in question is in the Town’s right of way and he is appearing to request permission to work within this right of way. The Board has no problem with this and so granted permission to work in the right of way area. Bill asked the Board if the Town would help with paying for some of the paving work. Board agreed to look at it after he receives a price for the work. BRIDGE CLOSING ON KEYSER HILL ROAD Read letter from Vermont Agency of Transportation in response to an inspection made on July 9, 2008 on bridge #33 on Town Highway #19 (Keyser Hill Road). This bridge had been the site of a vehicular accident that caused damage to the guardrails, but this inspection was due to other concerns. Inspection of the bridge revealed severe deterioration of the beams. The bottom flange of the six beams is rusted completely through and the beam webs, up to 2 feet beyond abutment #2 have also completely rusted through. Buckling of the beams was evident on the abutment #1 end of the bridge. Due to these conditions the State recommended that the bridge be closed to traffic until appropriate repairs can be made. The Selectmen so concurred and have closed the bridge. Ted Faris reported he had looked over the bridge with others and it was felt the deck could be lifted off and the deck be repaired within a relatively short time. Ted to get prices.
